Mesothelioma Landmark Cases

Africa has been an important place as far as landmark cases involving mesothelioma is concerned. It has been a known fact that in the continent was where asbestos has first been widely used. That is far as a modern legal complaint against companies’ use of asbestos is concerned.

The first ever asbestos lawsuit was filed in 1929 in South Africa. However, no landmark court decision was made during that time because the asbestos company or plaintiff and the complainants reached a settlement agreement to prevent a possibly long and tedious court process.

The year 1960 came up with the first ever published article that served as a landmark legal case involving mesothelioma. The case was filed by Wagner and other mesothelioma complainants. The case involved about 30 cases of mesothelioma incidences identified to be caused by asbestos exposure.

In Western Australian state of the Australian continent, a landmark government decision was made in 1978. A significant town called Wittenoom was phased out and was forcibly evacuated and abandoned after the national health department warned of asbestos exposure and inhalation in the whole of the area. Consequently, the following year or in 1979, the Wittenoom asbestos victims were helped by an established organization for specifically for the purpose called Asbestos Diseases Society.

In 1995, June Hancock of Leeds enjoyed sweet victory when she won in a legal complaint against an asbestos producer called JW Roberts. Ms. Hancock tried her best to pursue the case and eventually win the landmark court battle because she principally sought justice for the death of her other family members. Her mom died in 1982 fro mesothelioma. During the case, Ms. Hancock herself was diagnosed with the malignant cancer in 1993.

Other legal cases followed. To date, it is said that there are still numerous mesothelioma complaints that are being heard in various and numerous courts all over the world. Such cases are usually observed and heard of in Africa, Australia and to a few small locations in the United States. Similar legal charges are yet to be heard in other parts of the world.

Every case, whether an individual suit or a class action suit, has the potential to be a landmark case. The battle of mesothelioma victims still rage on. In the foreseeable future, it is expected that more complaints are to be heard by courts and be talked about across different communities.
